Certification Basis
Section 04: Certification Process Mechanics
Definition
The complete set of airworthiness requirements (regulations at specific amendment levels), special conditions, exemptions, and equivalent safety findings that an applicant must comply with to obtain a design approval. The certification basis is established by the certifying authority early in the certification project and is documented formally. For a new TC, the certification basis is determined by the applicable regulations in effect on the date of the TC application, plus any later amendments elected by the applicant or required by the authority.

Establishing the certification basis is one of the most critical steps in a certification project because it defines the complete regulatory target. For amended TCs and STCs, the certification basis determination is more complex, involving an assessment of which regulations apply to the changed and affected areas of the design (see 14 CFR 21.101 for FAA rules on changed products).

The FAA certification basis includes the applicable 14 CFR airworthiness regulations at the amendment level in effect on the date of application, plus any special conditions, exemptions, and ELOFs.
